TERM AND CONDITIONS

Please read through the following terms and conditions carefully.

1. Your Booking
   Once we receive your deposit, subject to availability and our discretion, Poles Apart Travel will reserve a space for you on the selected holiday. This contract is only made between you and Poles Apart Travel.
2. Prices of the Tour(s)
   The prices listed in our brochure and website are based on costs and exchange rates at October 22, 2004. If the tour price dramatically increases (by more than 10%) a surcharge may be added. You have the right to cancel within seven days of notification of this surcharge without penalty.
3. Credit Card Payments
   Your authorization to use your Credit Card (Visa and MasterCard are accepted) for deposit and/or final payment indicates your compliance with our terms and conditions listed here, whether or not you have signed the appropriate draft. Verbal authorization of the use of your Visa or MasterCard credit card, confirms your reservation. A signed sales draft is required. If you would like to change a credit card payment after is has been processed, change fees will apply.
4. Changes or Cancellations
   
   1. Poles Apart Travel reserves the right to change or cancel your booking at any time in accordance with certain operating requirements or circumstances beyond our control.
   2. Should cancellation become necessary we will notify you as soon as possible and, if possible, will offer you a comparable alternative.
   3. If no alternative is available, or acceptable to you, you will be entitled to a refund of monies paid. Poles Apart Travel will be under no further obligations or liability and is not responsible for any extra costs incurred on any other travel arrangements.
5. Brochure/Website Information
   All the information on our website and in our brochure are accurate to the best of our knowledge as of October 2004. We cannot guarantee that any amenity or item mentioned will be available, especially if we do not have any direct control over it.
6. Holiday Details
   
   1. Poles Apart may change itineraries slightly to improve your tour. If such improvements are made, or unforeseen changes are made necessary due to conditions out of our control, we reserve the right to vary the itinerary and/or change hotels. Poles Apart is not responsible for any other travel arrangements affected due to such alterations.
   2. You are responsible for all travel arrangements and costs to/from the point of commencement and conclusion of the holiday.
   3. Airfare is not included in any Poles Apart Travel holidays.
7. Payment
   
   1. All amounts are listed in Canadian Dollars (CA$)
   2. A non-refundable deposit of CA$500 is required at the time of booking.
   3. The final payment must be made no later than two (2) months prior to the beginning of the trip.
   4. Payment in full is required no less than two (2) months prior to beginning of the trip.
   5. Poles Apart Travel reserves the right to cancel any bookings while applying cancellation charges, if payments are not received within the above specified dates.
   6. Your travel agent will, on the receipt of monies and confirmation of your booking, transfer such monies directly to Poles Apart Travel. All monies will be deposited as specified by law.
   7. Poles Apart Travel will be entitled to keep any interest earned from such deposits.
   8. All monies paid to us either directly or through a travel agent, be it a deposit or final payments, may be used by Poles Apart Travel in respect to the services to be provided and/or any outstanding fees to be paid under the tour program. Your payment of a deposit or final payment will be seen as an authorization for the disbursement as mentioned.
   9. Travel documents will not be forwarded until the final payment has been received.
8. If you Cancel
   
   1. Any notice of cancellation must be made in writing to Poles Apart Travel
   2. In case of cancellation on your behalf, the deposit will not be refunded, nor can it be credited to any other tour.
   3. The following fees will apply in case of cancellation on your behalf: More than sixty (60) days before departure: Deposit will be forfeited Forty-five (45) to sixty (60) days before departure: 30% of tour fare Thirty (30) to forty-five (45) days before departure: 50% of tour fare Ten (10) to thirty (30) days before departure: 70% of tour fare One (1) to ten (10) day(s) before departure: 90% of tour fare Day of departure: 100% of tour fare
   4. These cancellation fees are in addition to any fees that may be levied by your travel agent.
9. Liability
   
   1. Please make sure you have read the website and brochure carefully to make sure you understand what is and what is not included in the price. If you have any questions please ask. No allowance or refund can be made for meals, accommodation, excursions, etc that you elect not to take.
   2. Poles Apart Travel is not responsible or liable for any lost or damaged luggage or property, for injury, illness or death, or for any damages or claims whatsoever arising from loss, negligence or delay from the act, error, or negligence of any person not directly employed by Poles Apart Travel, or under its exclusive control. Poles Apart Travel is not responsible for any criminal conduct by any third party.
   3. It is your responsibility to comply with all laws concerning vaccinations and to have a valid passport.
   4. You agree that Poles Apart Travel may take film footage or photographs of you that may be used in the future for brochure and other advertising purposes, without obtaining further consent or payment.
   5. Special meal requirements can be made on a request basis. However, Poles Apart Travel cannot guarantee these requests, nor will it be liable if a client's special meal requirements are not met.
   6. Poles Apart Travel welcomes travellers with disabilities, however it is not responsible for the failure of any of its contractors or sub-contractors fail to provide such special needs or services, including wheelchair accessibility. If you do have any disabilities, please let Poles Apart Travel know in advance so we can make the necessary arrangements. Poles Apart Travel will not be responsible for any costs to provide extra health or safety needs.
   7. If you have any complaints during the trip, please inform either the tour manager or the tour guide. If the complaint cannot be solved at that time, please write a letter of complaint directly to our office at the end of your journey.
   8. If you are unsuccessful in any legal action against Poles Apart Travel, you agree to pay all the costs, including, but not limited to, attorney and client costs.
   9. The Poles Apart Travel tour manager may have to make decisions at times that are in the best interest of the travel group. You hereby agree to comply with the authority of the Poles Apart tour manager, or the representative, and the laws of the country of which you are visiting. If you do not comply, or are incompatible with the enjoyment of the remainder of the group, Poles Apart reserves the right to refuse to let you continue with the holiday. In such a case you will be responsible for any costs to return home, without any claims against Poles Apart Travel.
      
      1. Poles Apart is under no circumstances responsible for any weather conditions, such as snow, heavy rain, etc. that may cause delays or cancellations, nor can the holiday be cancelled or amended by you at any time due to weather conditions.
      2. These terms and conditions contain the entire contract between you and Poles Apart Travel. No representation, term, warranty or condition can be expressed or implied by reference to any other writing, advertisement or conversation.
10. What is not included in the price.
    Airfares, airport taxes, passport fees, insurance, laundry, phone calls, beverages, meals not detailed in the itinerary, tips to tour managers/guides/coach drivers etc, items of a personal nature, excess baggage, optional excursions.
